Terms and Conditions

1. Assumption of Risk 

 I understand that while SageWell Home Care strives to provide high-quality and safe care, certain risks may exist during the delivery of home care services. I voluntarily accept and assume all such risks associated with receiving these services. 

2. Limitation of Liability 

To the fullest extent permitted by law, I release and discharge SageWell Home Care, its employees, contractors, and representatives from any and all liability, claims, demands, or causes of action arising out of or related to the provision of home care services, except in cases of proven gross negligence or intentional misconduct. 

3.  Independent Contractors 

I understand that some caregivers may operate as independent contractors and are not employees of SageWell Home Care. In such cases, SageWell Home Care is not liable for their actions beyond what is required under applicable law. 

4. Medical Emergencies 

In the event of a medical emergency, SageWell Home Care staff will act in good faith to obtain appropriate medical assistance. I release SageWell Home Care from any liability related to such emergency actions taken on my behalf. 

5. Service Hours and Payment Responsibility 

I understand that SageWell Home Care services are provided according to the number of hours approved by the funding agency, insurer, or program administrator. Approved services are covered under the client’s care plan, but any hours requested or received beyond the approved allocation are not covered. The client agrees to be personally responsible for payment of any additional hours or services beyond the approved allocation, at the current SageWell Home Care hourly rate. 

6. Single Agency Service Policy 

I understand that I may receive home care services from only one agency at a time under my approved funding or care plan. If I receive services from another agency simultaneously, I acknowledge that SageWell Home Care is not responsible for overlapping hours and agree to personally pay for any overlapping or unauthorized hours of care. 

7. Service Termination and Notice Requirement 

I understand and agree that home care services provided by SageWell Home Care are ongoing and scheduled to ensure consistent caregiver availability and continuity of care. Either the client (or their representative) or SageWell Home Care must provide a minimum of fifteen(15) days’ written notice to terminate or suspend services. SageWell Home Care reserves the right to suspend or terminate services immediately in cases involving unsafe working conditions, harassment, threats, non-payment, or other conduct that compromises staff or client safety. The client agrees to pay for all scheduled services rendered during the notice period, even if care is discontinued before the end of that period. The client also agrees not to solicit, hire, or privately engage any SageWell Home Care caregiver outside of this agreement for a period of six (6) months following termination of services.
